IS JUSTICE DELAYED REALLY JUSTICE DENIED IN PRESENT SCENARIO??

The role of #judiciary as the third wing of the government has ever increased considering the change scenario India is facing. The problems that India is facing now are numerous, be it the growing pollution in metro cities, crime against women and children, corruption, conflict between #central government and states or between the states. The role of Judiciary has witnessed tremendous growth with the passage of time.

The Judiciary has also witnessed several reforms by the inception of e-governance and m-governance. The courts proceedings have gained momentum manifolds but the pendency of cases in the Judiciary and especially in the lower judiciary has also witnessed the similar trend. Crores of cases are pending in the judiciary and the significant difference has not yet attained even after starting of initiates like Lok Adalats and Fast Track courts. It takes a lot of time for the victim to really get justice even after adopting  so many initiates by the courts. The petitioners are also growing day by day and one of the examples is the growth in cases in family courts.   

Can we say that the justice delivery mechanism is gaining inefficiency in present scenario in our country considering the piling up of cases? To this my honest answer is ‘no’. It goes with the explanation that the cases of different nature are also growing in number exponentially. The family courts have witnessed voluminous growth in the family disputes. In these cases The ‘Vision and Mission’ of the courts is to prevent separation of families and restoration of families considering the future of off springs and the future of the society that would be evolved if divorce between the spouses is granted at the earliest. The judiciary is wise enough to sense as to how to reach at the ‘just decision’ away from any bias. We need sensitive judicial officers (#judges) who can empathize with the ‘about to be broken family’ and at the same time keep alive the spirit of ‘justice to all’ in the society.
